On March 23, 2020, Governor Cuomo signed Executive Order 202.10, which limited the liability of our dedicated first responders with reference to treatment rendered to patients affected by the COVID-19 Pandemic. The full text of the Executive order can be viewed here.

Our first responders have been granted immunity from civil liability for any treatment rendered to patients affected by Coronavirus, with the exception of “gross negligence:, which is defined in New York as “reckless indifference to the rights of others”. The conduct in question must be a “failure to use even slight care, or conduct that is so careless as to show complete disregard for the rights and safety of others”. This will permit these heroes to assure that all of those affected in our community receive the best possible care during this difficult time.
